Robert M. Mullin, B.A. (Hons.), LL.B., LL.M., A.C.C.I. (Law)

Robert has quickly grown his practice to become one of the region’s preeminent knowledge leaders in condominium law. He is a frequent writer and accomplished speaker on a variety of condominium topics. Robert regularly works with developers, property management firms and condominium boards across Ontario to find creative, proven, practical and cost-effective solutions for the unique challenges that condominiums face.

Robert routinely advises condominium corporations on the creation of standard unit by- laws and indemnity agreements; the adoption of declaratory, by-law and rule amendments; amalgamations; maintenance, repair and insurance issues; changes to the common elements, assets and services; Tarion issues, performance audits, and construction deficiencies; reserve fund study and audited financial statement reviews; human rights claims; workplace violence and harassment policies; and enforcement procedures including liens, powers of sale, mediations and arbitration, and compliance orders. He also actively assists condominium developers in the formation of new condominiums, including agreements of purchase and sale, new declarations, by-laws, rules, management agreements, and disclosure statements.

Robert’s experience in civil litigation has brought him before a variety of administrative bodies and courts. He also acts on a variety of condominium enforcement proceedings, including mediations and arbitrations. Blending the strengths of his experience, Robert was co-counsel on a leading condominium case which resulted in the court’s appointment of both an administrator and inspector as a result of the board’s oppressive conduct.

Robert holds an Associate of the Canadian Condominium Institute (A.C.C.I.) designation, earned after demonstrating a high degree of condominium legal knowledge and experience. In November of 2009, Robert was elected President of the CCI Golden Horseshoe Chapter. He is also a member in good standing of the Toronto, London, Huronia, and Northwestern Ontario CCI Chapters, as well as A.C.M.O.

Robert also acts in the field of municipal law and land use development, appearing regularly before the Ontario Municipal Board representing both municipal and private sector clients. His Masters of Law in Municipal Law (LL.M.) from Osgoode Hall Law School is a unique resource. He often uses his education to assist clients in avoiding municipal liability and advising on land use planning controls and conditions. Robert provides ongoing Planning Act advice to municipalities on site plans, minor variances, legal non-conforming use, plans of condominium and subdivisions. In addition, Robert is intimately familiar with the Planning Act and associated legislation, namely: the Environmental Protection Act, the Environmental Assessment Act, and the Fire Protection and Prevention Act, as well as the Municipal Act and associated legislation: the Municipal Affairs Act, the Municipal Freedom of Information and Protection of Privacy Act, the Municipal Elections Act, the Municipal Conflict of Interest Act.

A strong supporter of volunteering and community leadership, Robert avidly contributes his professional and personal passions to local activities. He is a past-President of the Guelph Provincial P.C. Party Riding Association, and is a member of the Rotary Club of Guelph.

Robert graduated from the University of Guelph in 1995 with a Bachelor of Arts (Honours) in Political Studies. In the same discipline, he attended graduate studies at the University of Western Ontario. Following his graduate studies, he served as a political aide to the Honourable John C. Snobelen, Ontario’s former Minister of Education & Training, and served as the Director of External Operations for the Ontario P.C. Party. Robert continues to support a variety of candidates, notably serving as South-Western Ontario Leadership Campaign Co-ordinators for both the Honourable Ernie Eves, and the Honourable Tim Hudak, currently leader of Ontario’s Official Opposition. Robert received his LL.B. from the University of Windsor in 2002 and articled with the Toronto law firm of Cassels, Brock & Blackwell LLP, serving an extensive rotation with noted criminal defence lawyer Eddie Greenspan, Q.C. He returned to his home town of Guelph upon his call to the bar in 2003, and has now completed a Masters of Law (LL.M.) from Osgoode Hall Law School.
